Terms of Service

Last updated: 17 July 2026. These terms are a binding agreement between you and ECAVA Sdn. Bhd. (200501009701) ("ECAVA", "we"), the operator of the Bilvx platform ("the Service"). By creating an account or using the Service you accept them.

The Service

Bilvx is a software tool for preparing and submitting Malaysian e-Invoices to the LHDN MyInvois system and for keeping related books of account, including AI-assisted document capture. It is provided on a subscription basis under the plan limits published in the application.

Your responsibility for tax compliance

Bilvx is a tool; your tax compliance remains yours. You are responsible for the accuracy and completeness of every invoice and record you create, for verifying that every submission to LHDN was accepted, and for meeting every obligation the law places on you. Using the Service does not transfer any compliance obligation, filing duty or liability to ECAVA.

Errors, failures and missed submissions

You acknowledge and accept that:

  • the Service, like any software, may contain errors and may be unavailable, interrupted or degraded from time to time;
  • submissions to LHDN may fail, be delayed or be missed — including through defects in the Service, network or LHDN system conditions, or other causes — and it is your duty to monitor each submission's status in the application and with LHDN, and to resubmit or correct where needed;
  • AI document capture is assistive only — extracted values may be wrong or incomplete and nothing is recorded to your books without your explicit confirmation, which is your check, not ours;
  • reports and computed figures are derived from the data you entered and must be reviewed by you or your accountant before reliance.

No warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law. ECAVA does not warrant that the Service is error-free or uninterrupted, or that any submission will be accepted by LHDN.

Limitation of liability

To the fullest extent permitted by law: ECAVA is not liable for any indirect, incidental, special, consequential or punitive loss, nor for loss of profits, revenue, data or goodwill, nor for any penalty, fine, surcharge or assessment imposed by any tax authority; and ECAVA's total aggregate liability arising out of or relating to the Service is limited to the subscription fees you paid for the Service in the one (1) month before the event giving rise to the claim — which may be zero if you paid nothing. Your remedy for defects and unavailability is repair or re-performance as set out under Support, availability and your remedy, and every claim is subject to the Claims section below. Nothing in these terms excludes liability that cannot be excluded under Malaysian law.

Support, availability and your remedy

If you believe the Service has a defect, report it to the support address published on the Service. ECAVA will use commercially reasonable efforts to investigate and to repair verified defects within a reasonable time. The Service may be unavailable during maintenance or incidents; ECAVA works to restore it, but does not guarantee uptime. Repair or re-performance of the affected function is your sole and exclusive remedy for defects in, or unavailability of, the Service — see also Limitation of liability above.

Refunds

Subscription fees are non-refundable except where Malaysian law requires otherwise. Stopping use of the Service or closing your account part-way through a paid period does not entitle you to a refund of that period. Plan changes take effect as arranged with the operator of your deployment.

Your data

Your business data remains yours. You grant ECAVA the rights needed to operate the Service — to store and process your data, transmit submissions to LHDN, send uploaded documents to an AI service for reading, and deliver emails — as described in the Privacy Policy. You are responsible for the lawfulness of the data you enter, including having the right to upload your counterparties' details and documents. The law requires you to keep your own business records; the Service is not your archival system — keep your own copies of the source documents and records you are required by law to keep, and note that loss of data is subject to the No warranty and Limitation of liability sections.

Acceptable use, suspension and termination

You must not use the Service unlawfully, attempt to breach its security or to access other customers' data, or exceed reasonable use of shared resources. You may stop using the Service, or ask us to close your account, at any time — doing so does not entitle you to a refund of amounts already paid (see Refunds). We may suspend or terminate accounts that breach these terms, and may terminate the Service or your plan with reasonable notice. Before your account closes, make copies of anything you need; retention then follows the Privacy Policy.

Changes

We may change the Service and these terms. The "Last updated" date above changes when we do; material changes will be announced in the application, and continued use after a change is acceptance of it.

Claims

These conditions apply to every claim of any kind arising out of or relating to the Service:

  • Report first, and allow cure. Before bringing any claim you must report the issue in writing to the support address published on the Service, with enough detail to identify or reproduce it, and allow ECAVA thirty (30) days to cure. Repair or re-performance within that period fully discharges the matter (see Support, availability and your remedy).
  • Time bar. Any claim must be brought within three (3) months of the event giving rise to it, failing which it is waived.
  • Negotiation first. The parties will attempt to resolve any dispute in good faith for thirty (30) days before commencing proceedings.
  • Baseless claims are a breach. Repeatedly making claims or demands without reasonable basis is a breach of these terms (see Acceptable use, suspension and termination).

Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction.
